Limited liability and indemnity

What is never limited

Nothing here limits or excludes our liability for:

• death or personal injury caused by our negligence;
• fraud or fraudulent misrepresentation;
• the consumer guarantees given by the Australian Consumer Law about title, description, acceptable quality and fitness for purpose, which cannot be excluded, restricted or modified;
• liability for defective goods under Part 3-5 of the Australian Consumer Law;
• anything else that cannot lawfully be limited.

The live page this replaced tried to exclude liability for injury and to cap everything at $97. A term like that is not effective against a consumer in Australia, and we would rather say so than publish it.

What is limited

Subject to the section above, our liability for any claim connected with a product is limited to the price you paid for it. We are not liable for indirect or consequential loss, or for loss of profit, so far as the law allows.

Using a product safely

Follow the instructions supplied with the product and any age or weight limit stated on its page. Nursery products are aids, not substitutes for supervision: a bed guard, a playpen and a high chair all assume an adult is still watching. If a product arrives damaged or looks wrong, do not use it, and contact us.
